End User License Agreement

1. Terms and Definitions
- Application means “Humio — 3D Anatomy Atlas” for iOS, Android and Windows, intended for studying human anatomy using interactive 3D models.
- Content means all application materials: 3D models, text, images, animations, audio, data and interface elements.
- User means an individual who installs or uses the Application.
- Account means the user’s personal account created during registration.
- Subscription means paid access to extended application functionality for a defined period.
- Trial period means free access to application functionality for 1 day from first activation.
2. Subject of the Agreement
This End User License Agreement is a public offer and defines the terms of use of the Application.
The Operator grants the User a non-exclusive, non-transferable, revocable license to use the Application for personal, educational and non-commercial purposes.
Commercial use of the Application or Content, including use in educational institutions, clinics or derivative materials, is allowed only with the Operator’s written consent.
The territory of use is worldwide without jurisdictional restrictions.
3. Acceptance
The User accepts this Agreement by any of the following actions:
- installing or launching the Application;
- registering an account;
- purchasing a subscription or access plan.
If the User does not agree with this Agreement, the User must stop using the Application and delete it from the device.
Acceptance of this Agreement, registration or an earlier one-time purchase does not constitute consent to recurring payments. Such consent is obtained separately under section 5.
4. License and Restrictions
The User must not:
- copy, distribute, rent, sell or sublicense the Application or any part of it;
- modify, decompile, disassemble or reverse engineer the Application;
- bypass or violate technical protection measures;
- use Application Content commercially without written consent;
- remove or alter copyright notices or other markings.
Screenshots and video recordings are allowed for personal and non-commercial purposes when copyright attribution is preserved.
5. Subscription and Payment
5.1. Access plans. The trial period lasts 1 day from first activation and does not itself authorize a charge. The available plan, access period, full price, currency and whether renewal is automatic are shown before purchase. A price expressed per month for a longer plan is for comparison only; the full price for that plan is charged. Unlimited access is a one-time purchase without recurring charges.
5.2. Payment channel. Payments processed by App Store, Google Play or RuStore are governed by the relevant store's payment and subscription rules. Payments processed by YooKassa, including those initiated in an application downloaded from a store, are governed by clauses 5.3-5.12. The payment channel is shown before payment. Access is linked to the User's Humio account and may be synchronized across supported devices.
5.3. YooKassa. The payment service is provided by YooMoney NBCO LLC (ООО НКО «ЮМани»). One-time payments and, where the functionality is available, recurring payments using a saved bank card or linked Faster Payments System (SBP) account may be offered. SBP recurring payments require support from the selected bank or payment service. Ordinary payment by card or SBP does not itself activate renewal.
5.4. Separate consent. Before enabling renewal, the User is shown the plan, full amount and currency of each recurring charge, its frequency, the first scheduled charge date, the payment method and how to cancel. Consent is given by an explicit action specifically confirming recurring charges, such as selecting a checkbox or pressing a clearly labelled button. The Operator records the consent date and the agreed terms. Earlier one-time purchases remain one-time purchases. These provisions apply only after the functionality becomes available and the User separately enables it.
5.5. Linking a payment method. The User enters card details on YooKassa's payment page and completes any required bank authentication. To link an SBP account, the User selects a participating bank or payment service and confirms the authorization in its application. Linking may occur during payment or separately without a charge where supported. Linking alone does not purchase access. The Operator receives a payment-method identifier and limited display information, not the full card number or CVC/CVV. If the card issuer supports automatic card updates, authorized recurring charges may continue on a reissued card; reissuing a card does not replace cancellation.
5.6. Renewal schedule. After consent and successful linking, the Operator requests payment from YooKassa for the next access period without a separate confirmation for each charge, within the authorization granted. The amount and frequency are those explicitly agreed by the User. The first renewal is no earlier than the end of already paid access. Monthly and yearly periods are calendar periods; where a corresponding day does not exist, the last day of that month is used. Any introductory discount and the subsequent full price are disclosed before consent. A new period is granted after successful payment.
5.7. Notifications and price changes. The Operator emails the account address at least 24 hours before a scheduled charge, stating the amount, date and cancellation method. Payment confirmation and a receipt are sent in accordance with applicable requirements. Increasing the recurring amount or changing its frequency requires new explicit consent; publication of revised prices or terms alone does not authorize such a change. Without that consent, the Operator must not charge on the new terms and may stop renewal when the current paid period ends.
5.8. Failed payment. If payment fails, the Operator informs the User by email. Automatic retries are not made. Access remains available until the end of the already paid period; the User may pay manually or explicitly enable renewal again. A failed renewal does not create a debt for a new period that has not been provided.
5.9. Cancellation and withdrawal of authorization. The User may disable YooKassa renewal or prohibit further use of the saved card or SBP account by emailing info@humio.ru from the account email address. The message should identify the account and state the request, for example: “Disable renewal and stop using my saved payment method.” If account access is lost, the User may contact the same address for identification without supplying full card details, CVC/CVV or banking passwords. On the website, the User can open Account → Subscriptions and select “Turn off auto-renewal” or “Unlink payment method”. Unlinking also stops renewal and removes the reusable payment identifier from the Operator’s system. Once the Operator receives the withdrawal, no new charges or retries using that authorization may be initiated. Cancellation is confirmed on the website; requests made by email are confirmed by email. Deleting the application alone does not cancel renewal; a request to delete the Humio account also terminates its YooKassa renewal. Store subscriptions must be cancelled through the respective store.
5.10. Effect of cancellation. Disabling renewal does not cancel already paid access, which continues until its expiry. To prevent a scheduled charge, the withdrawal must be received before that charge is initiated. If a charge has already been initiated, the User may request a refund under clause 5.11; this does not permit any new charge after withdrawal.
5.11. Refunds and disputes about charges. Requests concerning YooKassa payments may be sent to info@humio.ru, identifying the account, payment date and amount, payment identifier or receipt if available, and the reason. Requests are handled and refunds made on the grounds and within the deadlines required by applicable law. Charges made without consent, duplicated charges and charges initiated after withdrawal are investigated and unjustifiably received amounts are refunded. Refunds are normally made to the original payment method through the payment service. Cancellation of renewal and a request to refund an earlier payment are separate actions. A refund of the initial payment alone does not revoke the recurring authorization; the User may request both actions in one message.
5.12. Mandatory rights. Nothing in this Agreement excludes or restricts mandatory consumer rights, including applicable rights to withdraw from a contract and obtain a refund. The Operator is responsible for organizing YooKassa renewals and handling related requests; the payment service processes payment instructions.
6. Account
Standard registration requires an email address and name. When purchasing on the website without signing in, the User enters an email address and agrees to account creation: after confirmed payment an account is created and sign-in details are sent to that address. The name can be added later. If the address is already registered, the User must sign in to the existing account. Sign-in with a Yandex account is also available.
The User is responsible for the accuracy of provided data and account security.
The Operator may block an account if this Agreement is violated.
7. Use of Materials
All rights to the Application Content belong to the Operator.
Commercial use of screenshots, videos or other materials obtained from the Application is allowed only under a separate written license agreement.
8. Updates and Changes
The Application may update automatically. Updates may change functionality, interface and available content.
The Operator may change subscription prices, subscription terms and this Agreement.
Changes do not reduce already paid access or replace consent to YooKassa recurring charges. Changes to the recurring amount and frequency are subject to clause 5.7.
9. Personal Data
The Operator processes the following personal data:
- email address;
- user name;
- application usage statistics.
- payment and subscription records, payment-method identifiers and limited display details, and records of recurring-payment consent and withdrawal.
Processing purposes include account support, service access, notifications, analytics and compliance with legal requirements.

10. Medical Disclaimer
The Application is for informational and educational purposes only. The Application is not a medical device and is not intended for diagnosis, treatment decisions or replacement of consultation with a qualified medical professional.
11. Limitation of Liability
The Application is provided “as is”. The Operator does not guarantee uninterrupted or error-free operation or compatibility with every device.
The Operator is not liable for direct or indirect losses arising from use or inability to use the Application.
These limitations apply only to the extent permitted by mandatory law and do not exclude the Operator's statutory liability.
12. Intellectual Property
All exclusive rights to the Application and Content belong to the Operator. This Agreement does not grant intellectual property rights except those expressly stated here.
13. Term and Termination
This Agreement is effective from acceptance until terminated.
The User may request termination by emailing the Operator. Stopping YooKassa renewal and withdrawing payment authorization are governed by section 5 and do not require deletion of the Application.
The Operator may terminate access if the User violates this Agreement.
14. Applicable Law and Dispute Resolution
This Agreement is governed by the laws of the Russian Federation.
Requests and claims may be sent to info@humio.ru. They are handled within the deadlines required by applicable law. Contacting the Operator does not restrict the consumer's right to seek judicial protection.
Jurisdiction is determined by law, including the consumer's right to choose a court where applicable.
